Terms of Service

1.1 These terms and conditions (“Terms of Use”) apply to all websites owned and/or operated by yourTCM ("yourTCM") including but not limited to www.yourtcm.sg (the “Site”). These Terms of Use also apply other services, including all information, communications, links, software, e-newsletters, products, services, other materials and any and all other services that may be added, offered or provided to you from time to time through the Site or other sites (the “Services”).

1.2 When these Terms use the term "Organiser," we mean event organisers using the Services to create events displayed on the Services for consumers using our Services (a) to consume information about or attend Events ("Consumers"), or (b) for any other reason. Organisers, Consumers and third parties using our Services are all referred to in these Terms collectively as "Users," "you" or "your."

1.3 When these Terms use the term "yourTCM”, "we," "us," or "our," that refers to yourTCM and its affiliates, and subsidiaries, and each of its and their respective officers, directors, agents, partners and employees.

 

1.4 this Site and any Services provided on the Site are not intended for persons resident in the European Union. By accessing or using the Site and/or any Service, you agree to be legally bound by these Terms of Use.

 

1.5 These Terms of Use may be revised or updated from time to time. The revised or updated Terms of Use will be posted on our site and your continued use of the Site and/or any Service shall be deemed and construed as your conclusive and binding acceptance of the revision or updated terms. These Terms apply to you as soon as you access the Services by any means and continue in effect until they are terminated. When that happens, these Terms will generally no longer apply.

 

1.6 We know your personal information is important to you and it is important to yourTCM too. Information provided to yourTCM by Consumers or collected by yourTCM through yourTCM Properties, is governed by our Privacy Policy and will be kept in strictest privacy and confidentiality.

 

2. About Our Services

yourTCM's services comprises of a few main services. First, yourCPE (“yourCPE”) provide a simple and quick means for Organisers to post, advertise, promote their events to potential Consumers, provide online ticketing and registration, and sell or reserve merchandise related to those events to Consumers.

yourCPE is not the creator, organiser or owner of the events posted on our Services. Rather, yourCPE provides a platform, which assist Organisers to manage ticketing and registration and promote their events. The Organiser is responsible for ensuring that the event meet all applicable laws, rules and regulations, and that the goods and services described are delivered as described and in an accurate satisfactory manner.

2.1 For Organisers:

 

2.1.1 yourTCM may terminate your right to use the Services at any time (a) if you violate or breach these Terms; (b) if you misuse or abuse the Services or use the Services in a way not intended or permitted by yourTCM; or (c) if allowing you to access and use the Services would violate any applicable laws, rules and regulations or would expose yourTCM to legal liability. yourTCM may choose to stop offering the Services at any time. We will use reasonable efforts to provide you with notice of our termination of your access to the Services, where, in yourTCM's sole discretion, failure to do so would materially prejudice you. You agree that yourTCM will not be liable to you or any third-party as a result of its termination of your right to use or otherwise access the Services.

 

2.1.2 As an Organiser, you represent, warrant and agree that (a) you will at all times comply with all applicable laws, rules and regulations with respect to information you collect from (or receive about) consumers, and (b) you will at all times comply with any applicable policies posted on the Services with respect to information you collect from (or receive about) consumers.

 

2.1.3 As an Organiser, you acknowledge that the applicable procedure to check the validity of the ticket must always be followed. yourTCM will not be held liable under any circumstances for any costs arisen from non-compliance by Organisers with applicable procedures that must be implemented by Organisers to check validity of tickets. yourTCM will not be held liable under any circumstances for costs and/or damage associated with tickets arisen from situations with fraud and/or for damage associated with the purchase of the ticket through non-official means, such as third parties.

2.2 For Consumers:

2.2.1 You acknowledge that yourTCM has no control over and does not guarantee the quality, safety, accuracy or legality of any event or Content associated with an event, the truth or accuracy of any information provided by Organisers (including the Consumer's personal information shared with Organisers in connection with events) or the ability of any User to perform or actually complete a transaction. yourTCM has no responsibility to you for, and hereby disclaims all liability arising from, the acts or omissions of any third parties yourTCM requires to provide the Services or an Organiser chooses to assist with an event.

 

2.2.2 You understand and agree that some events may carry inherent risk, and by participating in those events, you choose to assume those risks voluntarily. The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights. However, the duration of statutorily required warranties, if any, will be limited to the maximum extent permitted by law.

 

2.2.3 Our payment processing method uses third-party payment service providers to process the payment, where we will transmit Consumer's payment details to the designated payment provider. Consumers only can use the payment processing method we select. yourTCM also acts as the Organiser's limited agent solely for the purpose of using third-party payment service providers to collect payments made by Consumers on the Services and passing such payments to the Organiser.

2.2.4 yourTCM does not control (and thus cannot disclose) fees levied by your bank and/or credit card company, including fees for purchasing tickets and registrations in foreign currencies or from foreign persons. Be sure to check with your bank or credit card company prior to engaging in a transaction to understand all applicable fees, credit card surcharges and currency conversion rates.

2.2.5 Ticket Transfers. If you wish to transfer tickets to an event you have purchased on yourCPE, please contact the Organiser of the event.

2.2.6 Refunds: There are strictly no refunds for tickets bought for any event/courses posted in yourCPE. Please think carefully before purchasing.

 

2.2.7 Cancellation: You acknowledge that the applicable procedure to check the validity of the ticket must always be followed. yourTCM will not be held liable under any circumstances for any costs arisen from non-compliance by Organisers with applicable procedures that must be implemented by Organisers to check validity of tickets. yourTCM will not be held liable under any circumstances for costs and/or damage associated with tickets arisen from situations with fraud and/or for damage associated with the purchase of the ticket through non-official means, such as third parties.

2.3 yourTCM blog

2.3.1 yourTCM blog offer information about Traditional Chinese Medicine but is designed for educational and informational purposes only. The information contained on the Site and Services does not and is not intended to convey medical advice and does not constitute the practice of Traditional Chinese medicine. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. If you have any concerns or questions about your health, you should always consult with a physician or other healthcare professional for personal medical advice or treatment. You should not disregard, avoid or delay obtaining medical or health related advice from your health-care professional because of something you may have read on the Site. yourTCM is not responsible for any actions or inaction on your part based on the information that is presented on the Site. Your access and use of any of the Services and/or the Site does not in any way create a physician/patient, confidential or privileged relationship, or any other relationship that would give rise to any duties on yourTCM part or the part of its contributors. yourTCM does not recommend or endorse any specific tests, physicians, procedures, opinions, or other information that may appear on any of the Services and/or the Site. Your use or reliance on any information provided on the Services and/or the Site by yourTCM, its contributors, licensors, third party content providers, or other users is solely at your own risk.

2.3.2 yourTCM may, through the Services or the Site, allow licensed TCM physician to submit contribution (including but not limited to any text, graphics, video and/or audio content, and other materials or information) (“Submissions”) to yourTCM or to the Site directly. These licensed TCM physicians are solely responsible for their own Submissions. By submitting your Submissions, you agree as follows:- (a) you will not include any content in your Submissions that is or could be unlawful, defamatory, offensive, obscene, dangerous or false, or any content that is protected by copyright or other intellectual property right, without first obtaining permission of the copyright owner or rights-holder, or any content that contains any viruses, bugs or other harmful elements; (b) you hereby grant to yourTCM a perpetual, worldwide, irrevocable, nonexclusive, royalty-free and sub-licensable right and licence to use and exercise all copyright and publicity rights you have in your Submissions in any media and for any purpose; (c) you will not assume a false identity or the identity of another user when using the Site or any of the Services, and you will not use the Site or any of the Services for any unlawful or illegal activities, including but not limited to spamming, harassing or otherwise causing distress to other users.

 

2.3.3 yourTCM shall have the right, but not the obligation, to monitor the Submissions contributed to the Site and the Services. yourTCM shall have the right to remove, delete, or reject any material that yourTCM, in its sole discretion, finds to be in violation of these terms or otherwise objectionable or inappropriate without having to assign any reason therefore. In addition, yourTCM shall have the right to terminate your use of the Site and/or any of the Services if it believes that you have violated these terms or for any other reason whatsoever, without notice to you.

2.4 yourTCM online shop

2.4.1 yourTCM online shop sells TCM-related products. It features local TCM publications written by local TCM physicians and published by local TCM organisation in Singapore. All listed prices are in SGD (Singapore Dollars).

 

2.4.2 Return and Refund policy: There is strictly no return and refund of goods. All our products are checked to ensure its good condition before they are dispatched to customers. However, in the event that your order is faulty (missing pages, mis-prints), we will look into making a one-to-one exchange. Simply email us at yourtcmportal@gmail.com the picture of the damaged book, and we will contact you.

2.4.3 Shipping policy: We provide free shipping for delivery within Singapore. A flat shipping fee of SGD $5 is applicable for delivery to Malaysia. A flat shipping fee of SGD $20 is applicable for delivery to the rest of the world. Orders will usually be processed and dispatched within 14 days from the date of confirmation. While we make every attempts to fill all orders placed, some products may be delayed because of shipment arrangement or backordered. If this is the case, you will receive notification via e-mail. All standard shipping are dispatched / mailed out via local post office (SingPost); under standard registered mail. Once the orders have been handed over to SingPost, we have no control over the delivery and hence, we are unable to accept requests for preferred delivery date and time. Deliveries to overseas destination (outside Singapore) may be subjected to import duties and taxes. As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to; payment of these is necessary to release your order from customs on arrival. For more information regarding your country's customs policy, please contact your local customs office.

3. Third Party Websites

 

3.1 The Services may provide links to other Internet websites or resources. Because yourTCM has no control over such websites and resources, you acknowledge and agree that yourTCM is not responsible for the availability of such websites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, services or other materials on or available from such websites or resources, or any damages or losses related thereto, even if such websites or resources are connected with yourTCM partners or third party service providers.

3.2 Any and all use of any and all Services and the Site by you shall be at your sole risk. yourTCM makes no representation or warranty, whether express or implied (to the extent permitted by law): (a) as to the use, security, accuracy, reliability, non-infringement, satisfactory quality or fitness for any particular purpose of the Site or any Service; or (b) that the use of the Site or any Service will be uninterrupted and free of any error, viruses or bugs.

3.3 The foregoing disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tortious behaviour, negligence, or under any other cause of action. You specifically acknowledge that yourTCM is not liable for the defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with you.

3.4 Where you subscribe for any services on the Site and/or any Services that relates to any advertisement or other similar third party services, whether as a potential seller or buyer, you hereby expressly acknowledge and agree that the Site and Services act as a venue only and yourTCM is not responsible for the reliability, accuracy or truthfulness of any information that is posted in these services.

4. Liabilities

 

4.1 In no event will yourTCM, or any person or entity involved in creating, producing or distributing any of the Services and/or the Site, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the Services and/or the Site. You hereby acknowledge that the provisions of this section shall apply to all content on the Services and/or Site.

4.2 In addition to the terms set forth above, yourTCM and its affiliates, information providers and content partners shall NOT be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained on any of the Services or the Site, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. Additionally, there are no warranties as to the results obtained from the use of the information.

4.3 In no event shall yourTCM or any of its affiliates or related corporations be liable for any loss, injury, damage, claims, costs or expense of any kind arising from any error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus or other harmful elements, communication line failure, breach of contract, tort, negligence, defamation, copyright infringement, breach of intellectual property right or any other cause of action.

5. Intellectual Property

All content and materials on the Services and the Site are the exclusive property of yourTCM or its content suppliers and may be downloaded or printed for your own personal and noncommercial use only. All copyright notices on downloaded or printed material must be retained. Save as specifically permitted here, you may not copy, reproduce, distribute, republish, repost, modify, transmit, make available to the public, adapt, create a derivative work or otherwise use or exploit any content on the Services or the Site in any way or for any purpose. In addition, you may not distribute or make available any part of the Services or the Site over any other website or any network.

 

6. Indemnities

You agree to defend and hold yourTCM, its affiliates and related corporations from and against all claims, losses, damages, costs and expenses, including legal fees on an indemnity basis, arising out of your use of the Site and/or the Services or any breach of these terms. In addition, yourTCM may use whatever information that is available about you to stop any such breach or any unlawful or inappropriate use of the Site and/or the Services, including informing any third party yourTCM deems appropriate of such breach or use and/or disclosing your personal information to such third party.

 

7. Severability

If any of these terms is held to be invalid or unenforceable, such term shall be struck out and the remaining terms shall be enforced. Any failure to act by yourTCM with respect to any breach by you or others of any of the provisions of these terms and conditions does not waive yourTCM’ right to act with respect to subsequent or similar breaches.

 

8. Notice

You hereby agree and acknowledge:- (a) that all electronic communications made pursuant to the use of this Site and/or any of the Services shall be given legal effect, validity and enforceability and shall have, between the parties thereto, comparable evidential value to that accorded to a signed written document; (b) not to contest the legally binding nature, validity or enforceability of any transaction on the Site and/or any Services on the ground that it was entered into electronically.

 

 

9. Governing Laws

 

These terms shall be governed by Singapore laws and any dispute arising out of the use of the Site and/or the Services shall be referred to the Singapore courts. You acknowledge and agree that by using any of the Services herein or the Site you submit to the jurisdiction of the Courts of the Republic of Singapore.

What is the information used for?

Your personal data will be collected, used, disclosed and/or processed by us for the following purposes:

  • To send you notices, information, promotions and updates including marketing and advertising materials in relation to our goods and services and those of third party organizations selected by us.

All information gathered by yourTCM is stored in systems that may only be accessed by authorised yourTCM staff using user ids and passwords.

yourTCM is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

yourTCM may amend this policy from time to time. If we make any substantial changes in the way we use your personal information, we will notify you by posting an announcement on our platforms. You agree that such posting will constitute sufficient and adequate notice to you of the changes. When you access, use and/or interact with the yourTCM, we or our authorized service providers may use "cookies", “web beacons” and other tracking technologies where small data files are sent to your browser, application or device to store and track information about you. The cookies, web beacons and other tracking technologies are used to track information such as the number of users and their frequency of use, online behavioral data, profiles of users and their preferred sites. They enable our own system to recognise you when you visit us again, enhance your web-viewing experience and allow for more effective online targeted advertising. You may accept or decline cookies by modifying the settings in your browser, application or device, if the browser, application or device so permits. However, note that you may not be able to use all interactive features on the yourTCM if cookies have been disabled completely. While this cookie can tell us when you interact with the yourTCM and which pages you visit, it cannot access other data including from your computer or storage device and it does not contain information intended to identify you personally.

yourTCM does not utilise persistent cookies to track, or target advertisements to, persons who are resident in the European Union.

Release

This policy is subject to any existing laws of the Republic of Singapore in relation to the protection of information and if required by any lawful authority for any legal purposes such as the enforcement of any laws or to prevent the breaching of any laws, we shall release all such information as is legally required by the requisite and lawful authority in accordance with the directions of the lawful court of the competent jurisdiction.
